My visa application has been rejected. What can I do?

Find out what you can do in case of a refusal of your visa application.

If your visa application is rejected, you have the following options: A new application with a new set of documents or an appeal as explained in the embassy's decision.

New application

After a rejection, it is possible to submit a new application with complete, meaningful and verifiable documents at any time. You will need a new appointment to lodge the application.

Appeal

Please read the explanations in the embassy's decision carefully. It also describes the legal options you have after your application has been rejected.

As described there, you can apply to the embassy for a review of the rejection (remonstration). You have one month after notification of the rejection to do so.

The remonstration must be submitted by a letter of remonstration in German sent to the embassy and signed by the applicant. Sending it by e-mail is sufficient. Please note the following points when writing the letter of remonstration:

  • Please always state the processing number (i.e. the last five digits of the reference number stated in the rejection notice) and your name in the remonstration letter.
  • Please provide up-to-date contact details where you can be reached for further enquiries, i.e. telephone number (including area code), mobile phone number, e-mail address and full postal address.
  • In the letter you can restate the case, please be sure to address the points mentioned in the rejection letter. You can also submit additional documents to support the application.
  • Your letter must be signed by you.

Your application will then be reviewed again by the embassy and, if applicable, the foreigners authority involved or the Federal Employment Agency. Once the re-examination has been completed, we will contact you to present your passport if the visa is granted.

If the visa cannot be issued even after the review, we will explain the reasons for the rejectionl in detail in a remonstration notice in German. You can then take legal action against the remonstration decision before the Berlin Administrative Court.

Third parties

You can ask a third person, e.g. a lawyer, to carry out the remonstration procedure for you. You must then submit a written power of attorney signed by you.

Please note that the embassy will then only conduct correspondence with your authorised representative.
